Family Law Frequently Asked Questions

1. Do I really need an attorney if I am getting divorced?
In most cases, yes an attorney is needed. They must know all of the state's current laws regarding divorce, and they will fight for your rights and custody if children are present.

2. What are the differences of a no-fault and a fault divorce?
A no-fault divorce states that neither party is responsible for the divorce. Examples of no-fault divorces include irreconcilable differences and incompatibility. A divorce with fault blames one side for the erosion of the marriage. This can include a myriad of possibilities such as adultery, abuse, alcoholism, or insanity.

3. What is a prenuptial agreement?
When two people are about to be married, they sign a contract stating how the assets will be divided upon divorce. Prenuptial agreements can be for anyone, not just celebrities. If one person is much wealthier, owns a business, or there is the possibility of earning a large sum of money in the future a prenuptial agreement may need to be considered.
